Sussex man Kyoji Mochizuki with warrant for arrest by Merseyside Courts

On the 19th of October 2022, a private prosecution was granted against Kyoji Mochizuki (‘the defendant‘) for offences contrary to s1 of the Malicious Communications Act 1988 and s4 of the Harassment Act 1997 for sustained attacks on a family including their female daughter.

District Judge Healey of Liverpool Magistrates Court has issued a warrant for his arrest

Rose Horan of Sussex police had previously closed an investigation into the defendant for the same matter, which led to the successful application for a private prosecution.

The court was shown images that the defendant posted online, tagging the victims, some images appear to be of child abuse. Other images were sexual images that were obscene.

The defendant has a previous Cyber crime conviction where Sussex World reported

A police statement says that Kyoji Mochizuki, 28, of Mansfield Road, Hove, appeared for sentencing at Lewes Crown Court on Friday (August 19) after pleading guilty at Hove Crown Court in July to four counts of unauthorised acts with intent to impair the operation of or prevent/hinder access to a computer, contrary to Section 3 of the Computer Misuse Act 1990.

The Sussex World report goes on to say

Earlier that year, in February, an email was received from a sender purporting to be from a man working for a company called Uberex, threatening to attack Sussex Police services in revenge for the force seizing electronic property belonging to Mochizuki in connection with another case, for which he was on bail.  

Detective Constable Paul Constable from the Surrey and Sussex Cyber Crime Unit said:

In addition to Sussex Police, Mochizuki launched an attack on Brighton and Hove City Council’s email system after he had been summonsed for failing to pay his tax. Their system effectively captured the 2,000 emails aimed at the council tax email inbox.

In 2022, Kyoji Mochizuki entered into an online feud after he was accused of trying to infect the computer of his victim.  Kyoji Mochizuki then went on to pursue a course of conduct against the family and even went on to target other people unrelated.

Kyoji Mochizuki created a malicious website targeting a teenage daughter and her father, labelling the daughter a prostitute and the father a paedophile. 

Kyoji Mochizuki also made pornographic images and created comments alluding to incest between the father and daughter.

The sickening website created by the defendant was ‘shared by, and encouraged by others” who are also now facing prosecution.
